The geographic reach of background screening companies in California ranges from providers that focus on delivering services locally or within a U.S. region while others provide services worldwide. There are several important criteria you should consider based on the geographic scope you expect to need support for. First, you should match the capability of the background screening firm to the broadest geographic recruiting scope that you have. This is important so that you don’t have a recruiting assignment outside of the scope of coverage of the provider you have selected. Of course, an alternative approach is to use a second provider to handle special recruiting assignment although this will means administering the services of multiple vendors. You also will need to understand the varying turnaround times for delivery results of the background check for different geographic areas. There will be some minor differences in turnaround time across the U.S. due to background screening firms needing to interface with different state and local courts that have varying ways of doing business, different hours of operations and schedules. In general, turnaround times should be within 72 hours, although many firms will have shorter times and some longer. For international background checks the time period is going to be much longer and will vary by country.

Background screening companies in California must comply not only with the Fair Credit Reporting Act (FCRA), but also state specific laws that govern consumer reporting agencies and background screening firms. Be sure that the background screening company you choose not only is in compliance, but also will provide you with the necessary support for your company to be in compliance as well. The following is a partial listing of some areas that some states’ regulate that may impact how you go about conducting background checks.

As of the end of 2012, 35 bills in 17 states and the District of Columbia were pending in the 2012 legislative session relating to the use of credit information in employment. Out of the total 35 bills, 34 addressed restrictions on the use of credit information in employment decisions. The total number of states that limit employers’ use of credit information in employment is now eight: California, Connecticut, Hawaii, Illinois, Maryland, Oregon, Vermont and Washington. Washington enacted legislation in 2007, Hawaii enacted legislation in 2009, Illinois and Oregon enacted legislation in 2010. To support ex-offender reintegration into society, some states have adopted policies that encourage employment opportunities for eligible applicants. A Connecticut law declares that, “the ability of re­turned offenders to find meaningful employment is directly related to their normal functioning in the community,” and therefore prohibits denial of public employment or a professional license based solely on a prior conviction. At least 27 states limit or prohibit the use of criminal records in public or private employment and for licensing eligibility. States have varying laws that regulate the practices of consumer reporting agencies including Private Investigator requirements. Some states require a consumer reporting agency to have a PI license to be authorized to conduct background investigations.
